Takedown notice requirements

To be effective under 17 U.S.C. § 512(c)(3), a written takedown notice should include:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material claimed to be infringing and information reasonably sufficient to locate it on Meme Instants
  • Your contact information (address, telephone number, and email)
  • A statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the copyright owner
  • Your physical or electronic signature

Counter-notices

If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notice to the designated agent above. Counter-notices must meet the requirements of 17 U.S.C. § 512(g)(3). We may restore removed material in accordance with the DMCA after receiving a valid counter-notice, unless the copyright owner files a court action.

Repeat-infringer policy

Localhost Ltd maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. This policy is adopted before user uploads are offered on Meme Instants and applies to user-directed content uploaded to the service.

A repeat infringer is a user who has been the subject of more than one valid DMCA takedown notice, or who we otherwise determine has repeatedly uploaded content that infringes third-party copyright. We may warn users, suspend access, or permanently terminate accounts based on the severity and frequency of infringement.

We keep records of DMCA notices received, actions taken on reported content, and account enforcement decisions (including warnings, suspensions, and terminations) to demonstrate good-faith implementation of this policy.

This policy does not apply to sounds in our curated catalogue that were not uploaded at the direction of users. Rights holders seeking removal of catalogue content should use the takedown process above.
